PLURINATIONALITY AND THE EXECUTIVE BRANCHIN BOLIVIA: INDIGENOUS REPRESENTATION, LEGALPLURALISM, AND DUE PROCESS

Plurinationality in Bolivia is presented as a constitutional project that seeks to recognize the country's rich cultural and legal diversity. Starting with the 2009 Constitution, the structure of the Executive Branch is examined, highlighting the continued underrepresentation of Indigenous and peasant communities, despite the law requiring equitable representation. Furthermore, legal pluralism and the tensions that arise between Indigenous and peasant jurisdictions and the ordinary justice system are analyzed, especially regarding respect for due process. The conclusion is that plurinationality requires profound reforms, intercultural coordination, and affirmative action policies that guarantee Indigenous participation in political power and the administration of justice.
